By clicking "I Accept", completing registration, browsing our website, or using any part of our Service, you represent and warrant that:

• Generate videos from images (image-to-video) or videos (video-to-video) using AI technology
• Download generated videos for your use

Important Note: Our Service uses third-party AI models and infrastructure. Service availability, generation quality, and processing times may vary. We do not guarantee uninterrupted access or specific quality outcomes.

3. User Accounts

To access certain features of our Service, you may be required to create an account. When creating an account, you must:

• Provide accurate, current, and complete information
• Maintain the security of your password and account
• Promptly update your account information to keep it accurate
• Accept all risks of unauthorized access to your account
• Be at least 18 years old or the age of legal consent in your jurisdiction

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. Content Ownership and Licensing

4.1 Your Input Content

You retain all ownership rights to content you upload to the Service ("Input"), including images, videos, and text prompts. However, by submitting Input to our Service, you grant AllVideoModels AI:

• A worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, and process your Input solely for the purpose of providing the Service
• The right to transmit your Input to third-party AI model providers (Runway, Pika, Volcano Engine, Luma, etc.) for video generation
• The right to use anonymized, aggregated data derived from your usage for service improvement and analytics

Important: Third-party AI model providers may have their own terms regarding Input data. By using our Service, you acknowledge that your Input may be subject to the terms of service of the underlying AI providers, and some providers may use Input to train or improve their AI models. We recommend reviewing the privacy policies of Runway, Pika, Volcano Engine, and Luma if you have concerns about data usage.

4.2 Generated Video Output

Subject to your subscription plan and these Terms, you own all rights to videos generated by the Service ("Output"). Specifically:

• Paid Plans (Starter, Pro, Unlimited): Full commercial usage rights with no attribution required. You may use, reproduce, distribute, display, and create derivative works from Output for any lawful purpose, including commercial use.
• Free Plan: Personal, non-commercial use only. You must not use Output for commercial purposes, sell Output, or use Output in any revenue-generating activity.

Output License Grant to Us: You grant AllVideoModels AI a perpetual, worldwide, non-exclusive, royalty-free license to use, display, and distribute Output for the following limited purposes:

• Showcasing the Service in marketing materials, demonstrations, and promotional content (with your prior consent for identifiable content)
• Training and improving our AI model selection algorithms (not the underlying AI models themselves)
• Providing technical support and debugging

4.3 Service Intellectual Property

The Service itself, including its design, interface, algorithms, code, logos, trademarks, and all other proprietary elements, are and will remain the exclusive property of AllVideoModels AI and its licensors. You may not copy, modify, reverse engineer, decompile, or create derivative works from the Service.

5. Acceptable Use Policy

You agree to use the Service in accordance with our Acceptable Use Policy. You must not use the Service to create, upload, or generate content that:

5.1 Illegal Content

• Violates any applicable laws, regulations, or third-party rights
• Promotes or facilitates illegal activities
• Infringes copyright, trademark, patent, trade secret, or other intellectual property rights

5.2 Harmful or Offensive Content

• Contains violence, gore, or content that promotes harm to individuals or groups
• Is pornographic, sexually explicit, or contains nudity
• Promotes hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• Constitutes bullying, threats, or incitement to violence

5.3 Identity and Privacy Violations

• Depicts real individuals (including photographs, portraits, or likenesses) without their express written consent
• Depicts or appears to depict minors (individuals under 18 years old)
• Includes celebrity likenesses, public figures, or copyrighted characters without proper authorization
• Creates deepfakes or synthetic media intended to deceive, defame, or impersonate others
• Violates any person's privacy, publicity, or data protection rights

5.4 Fraudulent or Deceptive Content

• Contains misinformation, disinformation, or manipulated media presented as authentic
• Is used for phishing, scams, fraud, or identity theft
• Impersonates any person or entity without disclosure

5.5 Technical Abuse

• Attempts to circumvent usage limits, payment systems, or access controls
• Uses automated scripts, bots, or tools to access the Service without authorization
• Reverse engineers, decompiles, or attempts to extract the underlying AI models
• Interferes with or disrupts the Service or servers
• Uploads malware, viruses, or malicious code

We reserve the right to review content, suspend or terminate accounts, and report violations to law enforcement without prior notice. You acknowledge that you are solely responsible for all content you create using the Service.

6. Credits, Subscriptions, and Payment Terms

6.1 Credits System

Our Service operates on a credit-based system. Each video generation task consumes a certain number of credits based on the selected AI model, duration, resolution, and other parameters. Credit costs are displayed before generation.

• New users receive 20 free credits upon registration as a welcome bonus
• Credits can be purchased as one-time packs or obtained through subscription plans
• Credits are non-refundable once used for video generation (computational resources have been consumed)
• Unused credits do not expire for active accounts but may expire after 12 months of account inactivity
• Credits are non-transferable and have no cash value

6.2 Subscription Plans

We offer monthly and annual subscription plans (Starter, Pro, Unlimited) that include monthly credit allocations:

• Monthly Plans: Credits are allocated at the beginning of each billing cycle and do not roll over to the next month
• Annual Plans: Annual subscription credits are distributed monthly over the 12-month period, not provided in a lump sum
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before renewal
• Cancellation: You may cancel at any time via your account settings. Cancellation takes effect at the end of the current billing period
• Downgrade/Upgrade: Plan changes take effect immediately, with pro-rated credit adjustments

6.3 Payment Processing

All payments are processed through secure third-party payment providers (Creem, PayPal, Stripe). By making a purchase, you agree to:

• Provide accurate, current, and complete payment information
• Authorize us to charge your payment method for all fees and applicable taxes
• Update your payment information promptly if it changes
• Comply with the payment provider's terms and conditions

6.4 Pricing and Taxes

• All prices are displayed in USD and are subject to change with 30 days notice
• Existing subscribers will maintain their current pricing for the duration of their subscription term
• Prices exclude applicable taxes (VAT, GST, sales tax), which will be added at checkout
• You are responsible for all taxes associated with your purchase

6.5 Refunds

Due to the computational costs of AI video generation, refunds are limited. Please refer to our detailed Refund Policy for eligibility criteria. Generally:

• Unused credit packs may be eligible for pro-rated refund within 7 days of purchase if no credits have been consumed
• Subscription refunds may be available within 7 days of initial purchase or renewal on a pro-rated basis, subject to usage limits
• Technical failures preventing service use may qualify for pro-rated refunds or credit compensation

7. Disclaimers and Limitations of Liability

7.1 No Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ALLVIDEOMODELS AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, QUALITY, OR AVAILABILITY OF THE SERVICE
• WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE QUALITY OR ACCURACY OF AI-GENERATED OUTPUT

AI-Generated Content Disclaimer: AI-generated videos may contain artifacts, inaccuracies, or unexpected results. We do not guarantee the quality, accuracy, or suitability of Output for any particular purpose. You are solely responsible for reviewing and using Output.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALLVIDEOMODELS AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS OR YOUR CONTENT
• DAMAGES RESULTING FROM ERRORS, INTERRUPTIONS, OR UNAVAILABILITY OF THE SERVICE
• DAMAGES RESULTING FROM THE QUALITY OR NATURE OF AI-GENERATED OUTPUT
• DAMAGES RESULTING FROM YOUR RELIANCE ON ANY CONTENT OBTAINED THROUGH THE SERVICE

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

7.3 Third-Party Services

The Service integrates third-party AI models and infrastructure (Runway, Pika, Volcano Engine, Luma, etc.). We are not responsible for the availability, performance, or results of these third-party services. Any issues with third-party AI models are beyond our control.

8. Indemnification

You agree to defend, indemnify, and hold harmless AllVideoModels AI, its affiliates, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, and representatives from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms or our Acceptable Use Policy
• Your use or misuse of the Service
• Your Input or Output that infringes any intellectual property right or violates any law
• Your violation of any rights of another person or entity
• Any content you create, upload, or generate using the Service

9. Account Termination and Suspension

9.1 Termination by You

You may terminate your account at any time through your account settings or by contacting support. Upon termination:

• Your access to the Service will cease immediately
• Unused credits and remaining subscription time are forfeited (no refunds except as stated in our Refund Policy)
• We may delete your account data and generated content after 30 days

9.2 Termination or Suspension by Us

We may suspend or terminate your account immediately, without prior notice or liability, if:

• You breach these Terms or our Acceptable Use Policy
• We reasonably believe you are engaged in fraudulent, illegal, or harmful activity
• Your account shows signs of unauthorized access or security concerns
• Required by law or legal process
• We discontinue the Service (with reasonable notice)

9.3 Effect of Termination

Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

10. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

Important Note on AI Training: Some third-party AI model providers may use your Input and Output to train or improve their AI models. Please review our Privacy Policy and the privacy policies of underlying AI providers (Runway, Pika, etc.) for more information.

11. Dispute Resolution and Arbitration

11.1 Informal Resolution

If you have any dispute with us, you agree to first contact us at zhiming.zhao.apply@gmail.com and attempt to resolve the dispute informally for at least 30 days before initiating arbitration or litigation.

11.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding arbitration, except for disputes relating to intellectual property rights or small claims court matters.

11.3 Class Action Waiver

YOU AND ALLVIDEOMODELS AI AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will:

• Post the updated Terms on this page with a new "Last Updated" date
• Notify you via email or through a prominent notice on the Service at least 30 days before the changes take effect
• Provide an opportunity to review the changes before they become effective

Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes. If you do not agree to the changes, you must stop using the Service and terminate your account.

13. Governing Law and Jurisdiction

These Terms, together with our Privacy Policy, Refund Policy, and Acceptable Use Policy, constitute the entire agreement between you and AllVideoModels AI regarding the Service.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
